We have made every effort to display as accurately as possible the colours/size and images of our products that appear at the store. We cannot guarantee that your computer monitor’s display of any colour will be accurate.

We reserve the right but are not obligated, to limit the sales of our products or Services to any person, geographic region, or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.

We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made.

You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates so that we can complete your transactions and contact you as needed.

Additionally, when you visit our website, sign up for our newsletter, or make a purchase, we may collect personal information such as your name, email address, phone number, and payment details. In no case shall Genyve, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

You agree to indemnify, defend, and hold harmless Genyve and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

In the event that any provision of these Terms of Service is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.

SECTION 20 – SHIPPING TERMS

Genyve offers flat rate for shipping on every order. This means that you will never be charged more than the flat rate no matter how large the order is. The flat rate depends on the size and where the parcel will be delivered. You will be shown your flat rate at checkout. All orders over $150 will receive free shipping. 

Some postal services will allow you to give authority to leave depending on your region. By doing this you are giving your delivery company permission to leave your order in a safe place if no one is home to sign for your order. Genyve will not be held responsible for any theft or damage if you provide us with the authority to leave your parcel at an unattended address. All risk in the parcel will remain with you upon delivery and Genyve will not offer a replacement or refund for any loss or damage as a result of selecting to leave your parcel without a signature. As we are committed to your satisfaction, we work very hard to ensure you receive your order as quickly as possible. We aim to send your order on the same day if ordered before 9am AEST, however some orders may take a little longer. Please allow up to 3-5 days for most major capital cities (10 days for Perth and Darwin). However, we cannot control the speed of delivery by the courier services. If you live a little farther out, please allow a little bit of extra time. Please take every effort to include the correct delivery address details at the time of ordering. Should you enter the wrong address, we are not obliged to re-send the order to the correct address at our expense. Delivery times are highly dependent on your location and local transport services in your local area. The lead-times are measured in business days; they do not include weekends or public holidays.

Unfortunately Genyve currently DOES NOT offer international shipping options.

SECTION 21 – DISCOUNTS

Promo codes cannot be applied to previously placed orders. Promo codes are not transferable or redeemable for cash or credit. Only one discount code is permitted per order. For a discount code to be effective, the discount code must be applied at checkout. If a code is not applied correctly, Genyve will not refund the discounted amount once an order has processed. Please note a discounted upsell offer is considered a discount and will be considered as a discount.  Genyve reserves the right to decline or cancel any such orders that have had multiple discounts applied or do not meet these discount terms and conditions. We actively monitor the misuse of discount codes if we think there is or has been a misuse of a discount code in any way (e.g. selling it or sharing it with others), we reserve the right to cancel your discount code and/or suspend or even close your account without telling you. We don’t like to do this, but if a discount code can’t run properly because someone or something is spoiling the fun for everyone – e.g. fraud, tampering, technical errors or anything else that is beyond our control that affects the running or fairness of the discount code – we can cancel, modify or suspend the discount code. Orders purchased outside of the advertised time frame set out by Genyve will not be eligible for the discounted price.

Please note that during a sale or promotional period, orders cannot be cancelled, amended or changed in anyway. 

SECTION 22 – PROMOTIONS

We may, from time to time, run promotions where certain products, or a combination of products, are offered for sale at a discounted price or free of charge. All promotions are subject to availability and while stocks last. Any products purchased outside of the advertised time frame set out by Genyve will not be eligible for the promotional price. Where there is no promotion period specified, the relevant promotion will end when it is discontinued on Genyve platforms. 

SECTION 23 – AMENDING, CANCELLING OR CHANGING ORDERS

We have a small 10-minute window to cancel or amend orders during business hours. Any changes or amendments will need to be requested within 10-minutes of placing your order. Please note that during a sale or promotional period, orders cannot be cancelled, amended or changed in any way.
